Fideicomiso Explained: How Foreigners Legally Own Property in Baja
This is the question that comes up in almost every first conversation with a foreign buyer: can I actually own property here? The short answer is yes — through a structure called a fideicomiso, and it is far more straightforward than most people expect once it is explained plainly.
What a fideicomiso actually is
Mexican law restricts direct foreign ownership of land within the restricted zone — roughly 50 kilometers of the coastline and 100 kilometers of any border, which covers almost all of Baja California Sur. Instead of direct title, a Mexican bank holds the property in trust on your behalf, with you as the sole beneficiary. You have full rights to use, rent, renovate, sell, will to your heirs, or otherwise control the property, exactly as if you held title directly. The bank is simply the legal vehicle that makes foreign ownership possible under Mexican law.
What it costs and how long it lasts
A fideicomiso is typically set up for a term of 50 years and can be renewed indefinitely. There are setup costs and modest annual bank fees to maintain the trust, which vary by bank and by property value — your notary and the bank will quote exact figures for your specific transaction.
Is it safe?
Fideicomisos have been the standard legal mechanism for foreign coastal property ownership in Mexico for decades, used by hundreds of thousands of foreign owners without incident. The trust is registered, regulated, and enforceable, and the beneficiary rights are clearly defined by Mexican banking and property law.
