The Complete Guide to Buying Real Estate in Mexico as a Foreigner

Every year, thousands of foreigners buy property in Mexico, and the process is well-established and generally straightforward once you understand the basic steps. Here is the complete overview I walk every new client through.

Step 1: Understand the restricted zone

Land within roughly 50 kilometers of the coast or 100 kilometers of a border falls in Mexico’s restricted zone, where foreigners cannot hold direct title. Instead, you purchase through a fideicomiso, a bank trust that gives you full beneficial ownership rights. This covers essentially all of Baja California Sur.

Step 2: Get pre-qualified on financing, or plan for cash

Financing options exist for foreign buyers but are more limited and typically come with different terms than buyers are used to at home. Many purchases in this region are cash transactions; if financing is part of your plan, start that conversation early.

Step 3: Make an offer and open escrow

Once you find a property, your agent submits an offer, and upon acceptance funds typically move into escrow with a neutral third party while the paperwork is finalized.

Step 4: Due diligence

This includes confirming clear title, verifying there are no outstanding liens or unpaid property taxes, and, for condos, reviewing HOA financials. A qualified notario publico plays a central role in Mexican transactions and handles much of this verification.

Step 5: Closing

The notario prepares the final deed or trust documents, calculates applicable taxes and fees, and the transaction is registered with the Public Registry of Property. From offer to closing, the process commonly takes several weeks to a few months depending on financing and due diligence.
